Chancery Court at Knoxville -- March Rules, 1840, John Morrow and others, vs. The heirs of James Stephenson and John Buckey. It appearing from the allegations of the bill in this cause that Mary Earle, formerly Mary Buckey, George Buckey, Hannah Bosworth, formerly Hannah Buckey, Edith Crawford, formerly Edith Buckey, --- Carder, formerly --- Buckey, who intermarried with James Carder and which --- Carder has since died leaving three children who reside with their father and whose names are unknown, Meleney Buckey, William Buckey, --- Goff, formerly --- Buckey, who intermarried with David Goff.

Respondents in this cause, are not citizens of this State, it is therefore ordered that publication be made for four weeks in the Knoxville Register, requiring the said Respondents to answer, plead or demur to said bill at or before the next term of the Court, to be held on the first Monday of April, next, or judgment pro confesso will be taken against them and the cause set for hearing as to them at that time.

The bill in this cause states in substance that Wm Morrow, dec'd, late of Knox County, by his last Will, devised to his sons, Robert, Samuel and John, certain real estate in or near the town of Knoxville, that the said Robert conveyed by deed to the said Samuel and John, all his interest in the said property -- that the said John and Samuel, sometime in 1836 agreed to convey said property to James Stephenson and John Buckey and bound themselves by bond and security to make a title in fee to said real estate, whenever the $6,000, the consideration money should be paid, that $3,000 of the consideration aforesaid has been paid to said Samuel, for his interest in the said property and that the said James Stephenson and John Buckey executed their joint and several bond, bearing date 7th October, 1836 for the payment to the said John Morrow, on the 23rd July, 1830, of $3,000 with interest from the 26th August, 1836 for his interest in the said real estate and a lien on said property is retained in said bond to secure the payment thereof.

The bill further represents that the said James Stephenson and John Buckey, both died in the fall of 1838, without having paid any part of said bond, either of principal or interest and that the said Buckey, not having been married, died without heirs of his body. . .
